To legally operate a short-term rental property in Benidorm, you must meet a series of requirements and procedures established by the local and regional authorities. Below are the key aspects to consider:
Urban Planning Compatibility Certificate (CCU): This document, issued by the Benidorm City Council, certifies that the property’s tourist use is compatible with the current urban planning regulations. It is an essential requirement to move forward with the process of obtaining the tourist license.
Second Occupancy License: The property must have a valid Second Occupancy License, which confirms its habitability and compliance with the technical and safety conditions established.
Energy Performance Certificate: Although it is not always required to obtain the tourist license, it is mandatory to rent out the property and advertise it on short-term rental platforms.
Public Liability Insurance: You must take out public liability insurance to cover any potential damage to guests during their stay at the property.
Evacuation Rules and Emergency Phone Numbers: A list of emergency phone numbers and evacuation instructions must be placed on the property’s entrance door, in accordance with Decree 10/2021 of 22 January, of the Consell.
Registration on the SES.HOSPEDAJES Platform: As of 2 December 2024, Royal Decree 933/2021 takes effect, which establishes the requirement to register guests and provide detailed information to the authorities. Tourist properties must register on the SES.HOSPEDAJES platform to comply with this regulation.
Certificate from the Homeowners’ Association: You need a certificate from the homeowners’ association confirming that there is no prohibition on the tourist use of properties in the building.
Technical Requirements and Equipment: The property must meet the quality and safety standards set out in current regulations, including:
Domestic hot water.
Furniture in good condition.
A first-aid kit.
Internet connection, except in areas with no coverage.
Floor plan or visible evacuation rules.
Elevator from the fourth floor onward.
Parking: Under current regulations, the property must have a private parking space.
Notification to the Homeowners’ Association: It is recommended to inform the homeowners’ association about the property’s tourist activity and ensure that the community’s bylaws do not prohibit this use / The community certificate is required.
