HOW TO GET A TOURIST LICENSE IN BENIDORM?
To obtain a tourist rental license in Benidorm, you must meet a series of requirements set by the Valencian Generalitat and the Benidorm City Council.
Below is the complete list of requirements, divided into categories:
1. DOCUMENTS REQUIRED TO OBTAIN THE LICENSE
Any owner who wants to obtain a tourist license must submit the following documentation:
1. Deed of ownership or lease agreement
If you are the owner: a copy of the notarized deed or an extract from the land registry.
If you rent the property to someone else: a lease agreement that expressly allows subletting for tourist purposes.
2. Certificate of occupancy
An official document certifying that the home meets the minimum requirements for size, ventilation, lighting, and sanitary facilities.
3. Energy efficiency certificate
The minimum energy rating required for tourist rentals is E.
Document issued by an authorized technician.
4. Civil liability insurance
Minimum coverage: 300,000 €.
The policy must cover personal and material damages to guests.
5. Floor plan of the home and descriptive report
Detailed floor plan of the property, showing the layout of spaces and equipment.
The description must include floor area, number of bedrooms, kitchen, and bathrooms.
6. Administrative fee
The cost of the license in 2025 ranges from €250 to €500, depending on the property.
2. RULES REGARDING THE TECHNICAL CONDITION OF THE HOME
For a property to be rented to tourists, it must meet certain technical conditions:
✔ Access to running water and electricity – all installations must be in good working order.
✔ Adequate ventilation – each room must have windows or mechanical ventilation.
✔ Internet connection – from 2025, a high-speed Wi-Fi network is required.
✔ Minimum floor area:
36 m² for one person.
46 m² for two people.
+10 m² for each additional person.
✔ Equipped kitchen – it must include a refrigerator, hob, microwave, and basic utensils.
✔ Fully furnished – the home must have beds, tables, chairs, a sofa, and bed linens.
✔ Bathroom with hot water – at least one bathroom for every four people.
3. SAFETY REQUIREMENTS
To obtain the tourist license, the home must comply with fire safety and general safety regulations:
Fire safety:
✔ Smoke detectors in each bedroom and in the living room.
✔ Fire extinguisher in a visible location.
✔ Evacuation floor plan posted on the main door.
✔ Electrical and gas installations in accordance with current regulations.
Other safety measures:
✔ First-aid kit in an accessible place.
✔ Clearly marked emergency exits.
✔ Emergency phone numbers and rules of action in case of incidents.
4. GUEST REGISTRATION
Any owner who rents a home to tourists has the obligation to register all guests with the National Police or the Civil Guard within 24 hours of their arrival.
Steps to register guests:
1. Register in the system "Hospederías de la Policía Nacional".
2. Collect guests’ details (name, surname, passport number, arrival date).
3. Enter the information in the system or submit the form to the police.
Not registering guests may result in fines ranging from €600 to €30,000.
5. TAX OBLIGATIONS AND OFFICIAL INSPECTIONS
Taxes to pay:
✔ IRPF (Personal Income Tax) if you rent as an individual.
✔ VAT + Corporate Income Tax, if the rental is managed as a business.
✔ New tourist tax in the Valencian Community (in effect since 2024).
Inspections and audits:
✔ Random inspections every 2–3 years.
✔ Fines up to €60,000 for illegal rentals.
